PLEASE READ THESE TERMS AND CONDITIONS OF OUR PRIVACY POLICY CAREFULLY. IT EXPLAINS YOUR RIGHTS, WHAT INFORMATION PHELA HAS ACCESS TO, WHOM INFORMATION WILL BE DISCLOSED TO AND HOW WE USE IT. IF YOU ARE UNCERTAIN AS TO THE MEANING OF ANY OF THE PROVISIONS OF THESE TERMS, PLEASE ENSURE THAT YOU DISCONTINUE USE OF ANY SERVICES OFFERED BY PHELA UNTIL SUCH TIME THAT YOU ARE ABLE TO CONFIRM YOUR AGREEMENT HERETO.

 

WHAT PHELA PROVIDES THROUGH THE MOMENTUM WELLNESS PROGRAMME

Phela offers various health and wellness related services through the Momentum Wellness Programme, which you will have the benefit of as Momentum member.

When you register on the mobile app or website, you voluntarily give your consent for Phela to collect, store, use and process your personal information, and this document explains the manner in which Phela will be dealing with, and treating your personal information.

In having read this document and ticking the box when you register for the programme, you give your consent to Phela.

 

CONSENT AS PHELA MEMBER

  • As a member and when you access the services, a profile will be registered to your name, where all the personal information Phela collects about you will be captured.
  • Your personal information is usually of a private nature and includes information that relates to your race, gender, sex, marital status, nationality, ethnic or social origin, colour, sexual orientation, age, physical and mental health, wellbeing, disability, religion, beliefs, culture, language, education, medical, financial, employment history, email address, physical address, contact particulars and any information expressly relating to you.
  • By signing up as member or when you access the services, you unequivocally consent to your personal information being used by Phela, as set out herein.

How do you give your consent?

You understand, acknowledge and agree that your consent is given to Phela, which consent does not have to be in writing, and includes the following:

  • Your signature of a registration form in writing; or digital acceptance by ticking the box
  • Access and/or use of the phela website to view your profile; or
  • Access and/or use of the phela digital newsletter or the phela app; or contacting a phela call centre; or
  • Volunteering your personal information to a phela representative at a wellness day or during counselling; or
  • Making use of phela’s professional services/counselling services/health screening services; or completing a questionnaire found on phela’s site or app, or
  • Provided to you by phela or linked to phela in any manner; or
  • Not raising my express decline of consent, is construed as you having no objection to consent.

By using the site, registering or applying for Phela membership or any product of services that we render, or contacting Phela electronically or telephonically, you provide us with your express permission to share your personal information whether it is in the ordinary course of business, whether it is for administrative purposes or to allow us to render services and provide the product offerings that we do.

You agree that you will immediately inform Phela if you choose to withdraw your consent and understand that as a Phela member.

 

What is your personal information being used for?

Phela respects your privacy and this document explains how we treat your personal information.

  • Phela wants to protect your personal information and will not use it for any other purpose than that which is set out herein.
  • For Phela to capture your personal information and process and ascertain your health and/or psycho social status.
  • For Phela to create reports/recommendations which will be used to assess your health requirements and fields or areas that need attention for your wellbeing.
  • Analysing personal information to improve your wellbeing.
  • Statistical reports and purposes.
  • Administrative purposes and to process your instructions of requests.
  • To send you promotional material or details which we think may be of interest to you.

 

Who will have access to my information?

  • As Phela are focussed on the protection of your personal information, we will take any and all reasonable steps to ensure that it is not disclosed outside the purposes of use as set out herein.
  • To allow Phela to provide the services, Phela may have to share the information with third party suppliers, and your consent extends to us disclosing this to third parties.
  • We however do not control the actions of the third parties and if you do receive any correspondence or offerings from these third parties, Phela will not be bound to any undertakings or representations made by these parties.
  • You are urged to please consider the privacy policies of any third party Phela deals with and should you have objections to the use of your personal information by these parties you are to withdraw your consent and inform us expressly.

 

Is your personal information updated and correct?

  • As a Phela member, any and all of the information provided will be truthful, current and accurate and when any changes occur you agree to update it with your employer and ensure that Phela has the most updated version thereof.
  • You will, whenever using Phela’s services or accessing the website, do as yourself with your own identity and personal information and you shall not use it as an opportunity to gather information about others.
  • The health report generated by Phela with your personal information, is only as accurate as the truthfulness and completeness of the personal information you provided and you acknowledge that Phela requires you to complete as many fields as required to allow Phela to provide a proper health assessment report.

 

UNDERTAKINGS

  • Phela undertakes to protect your personal information from unauthorised disclosure and not to disclose it to my employer unless it has been de-identified.
  • Phela agrees to de-identify your personal information to the extent that it is used for statistics, which means that there will be no link to your identity insofar as the personal information is concerned.
  • Phela does not have control over the websites of third parties and to the extent that Phela provides undertakings herein, it does not extend to third parties or their websites or services rendered.
  • Phela undertakes to assist you in answering to the extent possible, and to the best of our ability, any reasonable questions you may have regarding the use of the Phela site or the collection and use of your personal information, or the recommendations generated regarding your health.

 

INDEMNITY

  • You agree to indemnify Phela from any damage or loss that may arise, directly or indirectly, as a result of:
    • your use of the Phela site which you subscribe to, access or use voluntarily;
    • the disclosure of your personal information to third parties;
    • the purchase of any products or services provided or advertised on websites linked to Phela.
  •  Even though Phela’s site may provide links to other sites or entities, You agree to indemnify Phela and will not hold Phela responsible for its contents as Phela is not in control thereof nor can Phela guarantee the functionality of those sites or verify the information contained therein.
  • Phela is indemnified and will not be held liable for inaccuracies on the Phela site, nor will Phela be bound to the terms and conditions of other sites linked to the Phela site, nor does a link to a third party website confirm that Phela endorses such a website or product.
  • You acknowledge that Phela cannot guarantee:
    • the content or material on the Phela site;
    • that the Phela site will be operational at all times as interruptions outside Phela’s control might occur;
    • that links to third party websites will be operational at all times;
    • the correctness or veracity of information contained on other sites linked to the Phela site.
